1. About us and these terms

This website is run by Animal Kingdoms Limited ("we", "us", "our").

These terms apply when you use animalkingdoms.co.nz ("the website") or buy from us. Please read them with our Refund Policy, Shipping Policy and Privacy Policy, which form part of these terms.

By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.

Our online store runs on Shopify. Payments are processed by our payment providers. We never see or store your full card details.

2. Your consumer rights

If you buy as a consumer, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these terms limits or excludes those rights.

If you buy for business purposes, you agree that the Consumer Guarantees Act does not apply, as allowed by section 43 of that Act.

3. Using the website

  • You must be 18 or over to place an order, or have permission from a parent or guardian.
  • Please give accurate, complete and current details when you order or create an account. You are responsible for keeping your account login secure.
  • We try to keep product descriptions, images, prices and stock levels accurate. Colours on screen can differ from the real product. Packaging can change from what is pictured.
  • We may change, pause or remove parts of the website at any time.

4. Orders, prices and payment

  • Prices are in New Zealand dollars (NZD) and include New Zealand GST, unless shown otherwise. Shipping is added at checkout.
  • Your order is an offer to buy. We accept your offer when we dispatch the goods, or when we confirm your order by email as accepted. Only then does a contract exist. An automatic order confirmation email shows we received your order. It does not mean we have accepted it.
  • We may decline or cancel an order before we accept it, and in the cases below after we accept it. We will tell you, and refund or void any payment in full. Those cases are:
    • the product is out of stock, or is not yet released for sale;
    • the price, description or stock level on the website was clearly wrong;
    • the order breaks the purchase limits or automated purchasing rules in section 5;
    • a rural address was entered without rural shipping (see section 7);
    • we reasonably suspect fraud, or the payment is not authorised or not received;
    • the order breaches these terms in another way.
  • Payment methods are shown at checkout. If you pay with Afterpay, their own terms also apply to you. See our Refund Policy for how their fees affect change-of-mind refunds.

5. Purchase limits and automated purchasing

We want our products, especially new releases and limited items, to reach real collectors and families.

  • Purchase limits. We may limit quantities for each person, household, account, payment card, address or order. We may also limit or cancel orders that we reasonably believe are placed for resale by dealers, resellers or distributors.
  • No automated purchasing. You must not place orders, or try to, by using bots, scripts, automated software, browser extensions that buy for you, or any other automated tool. You must not add products to a cart or check out in a way that bypasses the normal use of the website. This includes using direct cart or checkout links, product or variant IDs, or product pages that are not yet live.
  • What we may do. If we reasonably believe an order breaks this section, we may cancel it and void or refund the payment. We may also cancel related orders, and block accounts, cards or addresses from future orders. Where we can, we will tell you by email.

We use automated checks to help find these orders. We do not publish how those checks work.

6. Coming Soon, pre-sale and new release products

  • Some products are shown before they are available to buy, marked Coming Soon. You can join a notify list, but you cannot order them until we release them for sale.
  • Release dates, stock levels and allocations come from our suppliers and can change. We cannot guarantee a release date or that we will receive enough stock for every order.
  • If an order includes a product that was not yet released for sale, we may cancel it and refund that payment in full.
  • Pre-sale products can be ordered before they arrive. The product page will state the expected arrival. If a pre-sale item is delayed or does not arrive, we will contact you. You can choose a full refund.

7. Delivery

  • We send tracked parcels within New Zealand with NZ Post Courier. See our Shipping page for rates, dispatch times and delivery targets. Delivery times are targets only.
  • Rural addresses must use rural shipping. If you enter a rural address and do not choose rural shipping, we may cancel your order and refund you. You are welcome to order again with rural shipping or a non-rural address.
  • International delivery is available on request. Please email us for a quote.
  • The goods become yours, and risk passes to you, when they are delivered to the address you gave us. If a parcel is lost or damaged in transit, please contact us. We will work with NZ Post to resolve it.
  • Please check your delivery address before you order. We are not responsible for delays or losses caused by a wrong address.

8. Layby

We offer layby at certain times of year, such as Christmas. Layby terms are on our Layby Information page, including deposits, due dates, cancellation fees and excluded products. Those terms apply to every layby order. Some products, such as Pokémon TCG products, cannot go on layby.

9. Returns and refunds

Change-of-mind returns, missing items, faulty items and wrong items are covered by our Refund Policy. The Refund Policy does not limit your rights under the Consumer Guarantees Act. If a product is faulty, you have those rights whatever the Refund Policy says.

10. Gift cards

  • Gift cards can be used on the website toward products and shipping.
  • Gift cards cannot be exchanged for cash, except where the law requires.
  • Gift cards bought from us currently have no expiry date.
  • Please keep your gift card code safe. We cannot replace a code that is lost or used by someone else, unless we are at fault.

11. Wishlist and other tools

We use third-party tools on the website, such as our wishlist and our payment and delivery providers. These tools are provided by their own companies, and their terms may also apply. We are not responsible for how these tools work.

12. Acceptable use

When you use the website, you must not:

  • break any law, or help anyone else to break the law;
  • give false information or pretend to be someone else;
  • harass, abuse, threaten or defame anyone;
  • upload viruses or harmful code, or interfere with the website's security or performance;
  • scrape, crawl or copy the website or its content, or collect other people's personal information, with automated tools;
  • use automated tools to create accounts or place orders (see section 5);
  • copy, resell or use the website or its content for commercial purposes without our written permission.

We may suspend or close accounts, and cancel orders, that break this section.

13. Reviews, comments and submissions

If you send us or post reviews, comments, photos or ideas, you allow us to use, edit and publish them in any media without payment. You must own them, or have permission to share them. They must not break anyone's rights or include unlawful, offensive or misleading content. We may remove any content at our discretion.

14. Intellectual property

Content on the website is owned by us or licensed to us. That includes text, photos, graphics and logos. Brand names and product images belong to their owners. You may view the website and print pages for your own personal use. Any other use needs our written permission.

15. Privacy

We collect and use your personal information as set out in our Privacy Policy, and in line with the Privacy Act 2020.

16. Our liability

  • Nothing in this section limits your rights under the Consumer Guarantees Act or the Fair Trading Act.
  • If you buy as a consumer, our liability is limited as far as those Acts allow. Where they allow a limit, our total liability for any claim about an order is limited to the price you paid for that order.
  • We are not liable for loss that we could not reasonably foresee. That includes indirect loss, such as lost profits or lost opportunities.
  • We are not liable for delays or failures caused by events outside our reasonable control, such as courier delays, supplier shortages, severe weather or system outages. If this happens, we will tell you, and you may cancel an affected order for a full refund.

17. Changes to these terms

We may update these terms from time to time, for example to reflect changes in the law or in how we operate. The terms that apply to an order are the ones on the website when you placed it.

18. General

  • If any part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • These terms and our policies are the whole agreement between you and us about using the website and buying from us.
  • These terms are governed by the laws of New Zealand. The courts and tribunals of New Zealand, including the Disputes Tribunal, can decide any dispute.
